Attackers will not get away- Kenyan President.

NAIROBI – Kenyan security forces were locked in a fierce, final battle with Somali Islamist gunmen inside an upmarket Nairobi shopping mall on Monday as huge explosions and a barrage of heavy gunfire echoed out of the complex.
A thick cloud of black smoke billowed out from the Westgate mall as Kenyan officials said the 50-hour-long siege — which has seen the gunmen massacre at least 69 people and take dozens more hostage — was close to being resolved.
“We think the operation will come to an end soon,” Interior Minister Joseph Ole Lenku told reporters camped outside the vast part Israeli-owned complex, which was popular with wealthy Kenyans and expatriates.
“We are in control of all the floors, the terrorists are running and hiding in some stores… there is no room for escape,” he said, adding that some hostages had been freed, but without giving specific numbers. Two gunmen were also killed in the fighting.
The Kenyan Red Cross said at least 63 people were recorded missing, thought to include hostages as well as those possibly killed or still hiding. Around 200 people were wounded, officials said.
Somalia’s Al-Qaeda-linked Shebab insurgents have claimed the attack, which began midday on Saturday, when the gunmen marched into the complex, firing grenades and automatic weapons and sending panicked shoppers fleeing.
Kenyan army chief Julius Karangi said the gunmen had different nationalities. Several foreign fighters, including Somalis with dual nationalities, are members of the Shebab force.
“They are from different countries. We have sufficient intelligence this is global terrorism,” Karangi said.
Lenku denied that any of the insurgents were women.
“There are no women, all the terrorists are men. Some of them had dressed like women,” he said
Shebab spokesman Ali Mohamud Rage warned that the hostages would “bear the brunt of any force directed against the mujahedeen” — signalling that hostages were being used as human shields.
Kenyan President Uhuru Kenyatta vowed the attackers will “not get away with their despicable and beastly acts.”
“We will punish the masterminds swiftly, and indeed very painfully,” he declared in a televised speech to the nation on Sunday, revealing that a family member — a nephew and his fiancee — were among the dead.
A Kenyan security source and a Western intelligence official said Israeli forces were also involved in the operation, along with British and US agents.
Non-Muslims selected for execution
The Shebab rebels said the carnage was in retaliation for Kenya’s military intervention in Somalia, where African Union troops are battling the Islamists.
“If you want Kenya in peace, it will not happen as long as your boys are in our lands,” rebel spokesman Ali Mohamud Rage said in a statement posted on an Islamist website.
Shocked witnesses said the gunmen tried to weed out non-Muslims for execution by interrogating people on their religion or asking them to recite the Shahada, or Muslim profession of faith.
The dead include four Britons including a British-Australian, two French women, two Canadians including a diplomat, a Chinese woman, two Indians, a South Korean, a South African and a Dutch woman, according to their governments.
Also killed was Ghanaian poet and former UN envoy Kofi Awoonor, 78, while his son was injured.
Mall worker Zipporah Wanjiru survived by hiding under a table with five other colleagues.
“They were shooting indiscriminately, it was like a movie seeing people sprayed with bullets like that,” she said, bursting into tears.

Security camera footage seen by Kenya’s The Standard newspaper showed gunmen raking toilet cubicles with a barrage of gunfire, apparently after learning that several people were hiding inside.
Cafe waiter Titus Alede, who leapt from the first floor of the mall to avoid being killed, said it was a “miracle from God” that he managed to escape the approaching gunmen.
“I remember them saying ‘you killed our people in Somalia, it is our time to pay you back’,” he said.
Other survivors said they played dead to avoid being killed.
Israeli interests in Kenya have come under attack before, and the Westgate mall — popular with well-to-do Kenyans, diplomats, UN workers and other expatriates — has long been seen as a potential target.
World powers condemned the chilling attack, which is the worst in Nairobi since an Al-Qaeda bombing at the US embassy killed more than 200 people in 1998.
US President Barack Obama called Kenyatta offering support “to bring the perpetrators of the attack to justice”, while UN chief Ban Ki-moon said the violence was “totally reprehensible”.
On Monday, the International Criminal Court excused Kenyan Vice President William Ruto from his crimes against humanity trial over deadly 2007-08 post-election violence for a week so he can deal with the attack.
Ruto’s lawyer Karim Khan called the siege “Kenya’s 9/11.”

Idris Elba Covers GQ Looking All Types Of Dapper, Discusses Finding Out Son Isn’t Really his.

Idris Elba Covers GQSometimes you just have to sit back and thank the Lord for his many unforeseen blessings, like Idris Elba on the Cover of GQ magazine. I, for one, know this certainly brightened my morning.
Talking about his time on “The Wire,” acting in “Pacific Rim,” and what we can expect from “Mandela” this Fall, Idris is looking something like a dapper don is his GQ photo shoot, which is why the mag decided to include shots of him with a guideline on how to “Transform a Three-Piece into a Triple Threat.” Word of warning to all the men folk out there, you can’t do it like Idris — but we’re not mad if you try. Idris doesn’t sound like he’d be either, since, from the sounds of his interview, he is insanely oblivious to the power of his uniquely good looks.
“I sort of blended into the background quite a bit. I wasn’t the guy that was a big personality. I was the tall, silent, quiet type,” he told the mag of his life before fame. “I call it the invisible factor. On any ordinary street, walking down in London Soho in a cap, I’m just a f**king tall black man walking along.”
He seems to have left the word fine out of that last sentence. Don’t worry, we’ll fill it in for him.
Making him all the more charming, Idris also opened up to GQ about his prior marriage and the breakdown of the relationship:
“I liked the idea of being married. I was focused in on what I was trying to do in my life. And my girl supported me.”I had to keep going back and forth to New York, to London, to try and make a bit of money real quick. [She] didn’t adjust to the culture as quickly as I did. We just had a hard time. The next thing you know, we broke up.”
At the time, Idris’s ex-wife was pregnant and he was sleeping in an Astro van.
“I mean, it was like, ‘F**k, where did I go wrong?’ I had a lot of promise in England, you know? ‘What the f**k are you doing here? Your visa’s going to run out soon. You’re going to have a baby. What the f**k are you doing?’ That’s what’s going through my head.”
Not long after, Idris got picked up on “The Wire” and the rest was history — that is until the actor got involved with a new woman and began proudly boasting about having a son, only to find out it wasn’t his. As GQ tells it:
He was dating a woman in Florida, had been for a couple of years. They were living together and in love. She became pregnant and gave birth to a boy. For a brief moment, it was among the happiest times of Elba’s life. “The celebration of having a son—from a man’s perspective, it’s massive.” He told friends about it. He told reporters about it. Then came the suggestion—not from the child’s mother, but from elsewhere—that not everything was what it appeared to be. “It wasn’t immediately obvious—well, it was, because he didn’t look like me,” Elba says. “But it wasn’t immediately obvious what had gone down.”
Eventually, Elba decided to take a paternity test, which showed the child wasn’t his. “To be given that and then have it taken away so harshly,” he says, “was like taking a full-on punch in the face: POW.”
And then there was the fact that he’d mentioned the kid in public, the knowledge, even then, that at some point he’d be sitting in a room like this one, being asked about the worst, most humiliating thing that ever happened to him. “You know, the truth is—like, even admitting it, I’ll probably get laughed at for the rest of my life. But it is just tragic, and it happened.” He looks directly at me when he says this. “But I wasn’t knocked out. I stood right the Fawk back up, and I ain’t aiming to take another punch in the face ever again. Do you understand what I’m saying? It happened to me. I moved on.”

Poloice confirm 7 killed at Apo ligislative quarters

Abuja – The Police have confirmed that seven persons were shot dead in two uncompleted buildings behind the National Assembly Quarters in Apo, Abuja , early  on Friday.
The buildings are located at Zone E in the area.
Mr Sunday Odukoya, the Assistant Commissioner of Police in-Charge of Abuja Metro Area Command, confirmed the killings to newsmen on Friday.
Commenting on an allegation that the victims were killed by soldiers, Odukoya said: “I have not heard something like that.

Agagu to be buried Beside his father's grave

Okitipupa (Ondo State) – The late former governor of Ondo State, Dr Olusegun Agagu, is to be buried beside his father’s grave, his Kuyeju family in Lameha Quarters, Iju-Odo, has said.
The News Agency of Nigeria (NAN) reports that the late governor, who was 65, slumped and died on Sept. 13 at his Ikoyi residence in Lagos.
NAN also reports that the Ondo State Government has officially announced that Agagu would be buried on Oct. 4 at Iju Odo, Okitipupa Local Government Area of the state.
Chief Samuel Akinrogunde, a member of the Kuyeju family, told NAN on Friday in Iju Odo that Agagu had ordered that he should be buried beside his father’s grave at St. Paul’s Anglican Church cemetery.
“Before he died, he had ordered that he should be buried beside his father, late Chief Olorunfemi Agagu, who died in March 1973 and was buried at St. Paul’s Anglican Church,’’ he said.
Akinrogunde also thanked the state government for making the burial of the late former governor an official responsibility of the present administration.
He added that the family would begin early preparations for the Oct. 4 burial, adding that necessary arrangements would be made to forestall any hitch.
“Since the state government has announced Oct. 4 as the official burial date for Agagu, we will put our house in order to ensure a befitting burial for our son,’’ he said.
Akinrogunde, who also heads the family burial committee, said the body would collaborate with the government’s committee to ensure a befitting burial for the late politician. (NAN)

Blackface reacts to Tuface’s alledged wedding invitation

Against the backdrop of the recent interview where 2face alleged he had invited Blackface to his wedding,Blackface has reacted in an interview with Abuja based radio station Hotfm stating that 2face keeps avoiding him for reasons best known to him.
He says he’s been trying to get across to 2face to talk about his song African queen that has been sang by a Jamaican artist in the US without the right to do so…’ if someone sings that song it means someone gave out the right ’he keeps avoiding me cos he doesn’t want to talk about these issues.

Rivers PDP tags Amaechi A failure

The Rivers State Leadership of the Peoples Democratic Party, PDP, says it’s not surprised at Governor Chibuike Amaechi’s declaration of his membership of a tiny over-ambitious clique under a purported factional PDP whose only interest is to scatter the party and stop President Jonathan’s second term bid.
The party in a statement issued and signed by the Special Adviser on Media to the State Chairman, Jerry Needam said even though the reasons why Amaechi had scuttled all moves for peace in the state and stability in the PDP were not lost on it, his open declaration and support for those that never wish the PDP and President Goodluck Jonathan well has now left no one in doubt as to his real interest and purpose.
Regrettably, the party noted, Amaechi has already failed before he started because no one in political history had been used against his own and survived it.
It described Amaechi and his colleagues who are the foremost beneficiaries of the party’s toil as devil incarnates for plotting to destroy the very platform through which they got to the pinnacle of their political career.
The party reasoned that at worst, what Amaechi and his drummers ought to do if they no more feel safe in the PDP is to decamp or form their own party. But rather than do that they have chosen to stay put, to make sure they destroy the party but reassured them that their aim will not come to pass.
“While we wish you well in your chosen path against your own people for a pot of porridge, don’t say you were not told because you must fail in your bid and by the time you realize that, it would have been late,” the PDP replied Amaechi.
On the declaration of support of Magnus Abe, Wisdom Ake, Dakuku Peterside, Leyii Kwanee for the purported factional PDP, the party berated these lawmakers for blindly and sheepishly following their paymaster, Gov. Amaechi to destabilize the state and the nation.
The party regrets that these nondescript persons could be easily swayed like a pack of cards against the collective will of the state to satisfy the whims and caprices of their paymaster who is bent on wasting the tax payers’ money on a lost battle.
“That these National Assembly members could descend so low to encourage illegality portrays them as lacking self-confidence and will forever remain political babies that can never be independent,” the PDP concluded.

Ebonyi Council Boss Arrested Over Rape Of Mother, Two Daughters

The alleged mastermind behind the rape involving the Councilor of Ndiagu Echara Ward I in Ikwo Local government Area of Ebonyi State, Mrs Margret Elom and her two daughters (names withheld) was arrested today [Monday] by men and officers of State police Command in Abakaliki.
The State Police Public Relations Officer, PPRO, DSP Sylvester Igbo who confirmed the arrest of the suspect, Hon. Sunday Otah, the Vice Chairman Ikwo LGA to 47ureports.com revealed that he (suspect) was arrested by the police based on the confessional statements made by another suspects, Sunday Nwaokponkwu, allegedly involved in the rape saga.
The mother of the victims who is also the current councillorship candidate of Ndiagu Echara Ward I in the last Peoples Democratic Party, PDP councillorship election in the state reported the incident to the police.
It should be recalled that the suspects who came at night when their victims were asleep raped them in turns at gun point after stealing the sum of N50, 000, nine different models of handset and a Carter motorcycle from them.
According to Igbo, police investigation would determine whether Hon. Otah was involved in the rape incident or not.
In his words, “The Police today arrested the alleged mastermind of the rape incident that took place in Ikwo local government area of the State; when we interrogated him, he denied involving in the incident saying that it was political motivated. If our investigation proves that he is
guilty, he will be charged to court but meanwhile we are still investigating the matter and we are the one to determine whether the allegation against him are true or not

MBGN: How Anna Banner won.

YENAGOA—Miss Bayelsa State, Anna Ebierie Banner, weekend, emerged the winner of 2013 Most Beautiful Girl in Nigeria pageant with Imo State representative, Okwu Stephanie as 1st runner up.
Banner, 18, also won the best traditional costume award, beating other 31 contestants to clinch the crown at a ceremony held in Yenagoa, Bayelsa State capital.
Meanwhile, Governor Seriake Dickson of Bayelsa State has appointed  Anna  Banner as his Special Assistant on Culture and Tourism.
Anna  Banner is meanwhile to represent Nigeria at the Miss World pageant later this year in Jakarta, Indonesia.
She has now taken over the reigns as the Most Beautiful girl in Nigeria 2012 winner, Isabele Ayuk.
The Minister of Culture, Tourism and National Orientation, Chief Edem Duke, at the event, also announced the new queen as the Ambassador of Culture and Tourism in Nigeria.
Meanwhile, contestants who made it to the Top 5 were Miss Imo, Miss Abuja, Miss Kaduna and Miss Adamawa.
In his speech, Governor  Dickson called on investors to avail themselves of the numerous tourism potentials and investment opportunities in the state. “As a state, we consider it a unique privilege to have an array of important personalities and elegant young ladies in our midst today, just a couple of months after we hosted the prestigious Africa Movie Academy Awards, AMAA.

The Duchess of Cambridge and Prince William have welcomed their first child, a son, PEOPLE confirms.
The news the world’s been waiting for since Kate went into London’s St. Mary’s Hospitalearly Monday morning was revealed Monday afternoon, some four hours after the Duchess, 31, gave birth.
The message was delivered in a press release, stating that a son was born at 4:24 p.m., weighing 8 lbs., 6 oz. After about 14 hours of labor, Kate had a natural delivery.
With a broad smile the couple’s press secretary Ed Perkins took the announcement to a waiting blue Jaguar to be whisked to the palace.
Kate and William wanted to spend a bit of time with their baby and make their phone calls. But William, 31, personally told the Queen, his father, Prince Charles and wife Camilla. Kate’s parents were also called.
“It’s been a wonderful day and everyone’s delighted,” says a palace source.
British Prime Minister David Cameron is also among those informed, along with other high-ranking officials.
The waiting crowds celebrated near St. Mary’s. The theatrical presentation of the birth news continued when the official notice was placed on an easel on the Buckingham Palace forecourt. “Her Royal Highness and her child are both doing well,” it read. A gun salute in the royal parks in London is expected to follow.
The new arrival is third in line to the throne, following the baby’s father, William, and (first-in-line) grandfather, Prince Charles, 64. The public will get its first glimpse of the child when the couple leave the hospital in the coming days.
Kate’s pregnancy was revealed on Dec. 3, 2012, when she was admitted to the hospital in London suffering from severe morning sickness.
William spoke of the couple’s desire to have children when they announced their engagement in 2010. He told ITN they would get to planning after their wedding: “Obviously we want a family, so we’ll have to start thinking about that.” And he has since said that he wants two kids.

Signs of End time: Strange fish with human parts cause panic in Ibandan Today... Oyibo mammy water found in cartoon of frozen Fish.



It was a pandemonium in the ancient city of Ibadan on Tuesday as many people rushed to catch a glimpse of a strange fish which was said to have human parts at Asaka compound area of the city.It was like a scene from the horror film to see a mermaid in a broad day light. According to eye-wtiness,the strange incident happened at Ile Akindele when a fish seller noticed the strange creature after removing the wrap of a frozen fish. Ramota, who was said to be the fish seller reportedly, raised alarm to attract others to the strange sight. She said, “I went to where we usually buy fish at Kola Eleja, Oke Ado, Ibadan. After I finished, I boarded Okada to my place to prepare the fish for sale. Before getting the fish out of the ice-pack, we needed to use knife to remove them and use water to de-freeze. I was shocked to see the frozen fish developed into a living being in the water, the description of which showed half human and half fish. I quickly called my father and some Alfas to see the strange fish”. The father of the woman, a retired civil servant, Pa Rauf Salawu who corroborated the story said he had never seen such a thing before. He narrated his own side of the story saying, “it was around 11am, when I started hearing the voice of my daughter while I was resting on my bed. She was shouting and screaming to the extent that people in the compound were attracted. Then, I decided to check what was the problem. I took along my Quran and on getting there, my daughter had gone to call another Muslim leader in the neighbourhood. I saw the strange fish inside water in the bucket . It was strange, how can a fish bought in the cold room develop into human. That I cannot fully explain.” Due to the crowd, police men from Mapo police station were called to control the surging crowd. The fish seller was then taken into the custody of the police. Several calls made to the police were not picked.

In this part of the world and continent, men take a domineering role in the family. The man is seen as the head of the family. Because of that, most men take responsibility of making provision for the family in every aspect.
Back in the days, the role of women in the family was limited to the kitchen and the farms, where they helped their husbands. But things have changed now as some women have assumed the role of men in the family and mostly give support to men in terms of providing for the upkeep of the family.
For female celebrities in Nigeria, one challenge they face is getting young men that would marry them as wives, which has made some of them end up marrying men that are married with kids.
Most young men tend to stay away from them because they feel female celebs, apart from their reported wayward lives, feel they (female celebs) are richer than them. And because of this, most young chaps stay away from them.
Speaking on the type of man she would love to marry, Chidinma Ekile, Nigeria’s female singer and a former winner of MTN Project Fame said she would want a man that could take care of her needs and not the one she would feed.
According to her, “never, I can’t date a man that doesn’t have money, I can’t feed a man.” The singer also disclosed that she is not in a hurry to get married but that she is not in a relationship at the moment.

As the world waits on Nigeria to unravel the culprits behind the ridiculous 79 -0 and 67 -0 scorelines recorded in two matches of the amateur League play-offs, the Nigeria Police have brought a new twist to the whole drama by distancing themselves from one of the Clubs – Police Machine FC which  beat Bubayaro FC 67 – 0.
“The team that is involved in that fantasy scoreline is not Police Machine Team. The Police Machine team is a brand name for the Police team. The one you people are referring as Police Machine team are Police FC from Yola. It is a rag-tag team in the state and cannot be said to be the Police Machine team”, CSP Frank Mba who is the deputy Force Public Relations Officer of the Nigeria Police Force said yesterday on our hotline.
He was asked about the investigation of the alleged match fixing  by the amateur teams during their play offs.
“The Police Machine team are actually topping their Nationwide League in Abuja and cannot be said to be involved in this basketful of goals.
All the same, the Police have initiated investigation on our own without waiting for anyone. But our investigation is limited because there are certain technical areas we cannot go into.
Our Inspector General, M. D. Abubakar is a passionate sports man and was highly involved in football. He talks, sleeps and dreams football and as such has directed the DIG and Commissioner of Police in the zone to look into the matter.
We really want to understand what happened because we are very uncomfortable with the scoreline. We want to also see if all the people in the Police team are police men.
If they are, it makes it easy for discipline. It is possible that as a rag-tag team, they can recruit people from here and there.  For the IGP, anyone involved in bringing the beautiful game of football into disrepute will not go un-punished’’, Mba said.

Plateau United Feeders and Police Machine figured they needed a big win in the final round at an amateur tournament to outdo the other and earn promotion to Nigeria’s professional football leagues.

Glee's star cory Monteith found Dead in Hotel room

Glee star Cory Monteith has been found dead in a Vancouver hotel.
The 31-year-old, who played Finn Hudson in the Fox TV hit, was found dead at the Pacific Rim Hotel in the city centre on Saturday, said police.
The cause of death was not immediately apparent, but police have ruled out foul play.
Monteith, who had been in the musical comedy since its 2009 start, was treated for drug addiction in April, and had a history of substance-abuse.
His body was found by Pacific Rim staff after he missed his check-out time at midday on Saturday, said Vancouver’s Deputy Police Chief Doug Lepard. Monteith had been dead for several hours, he added.
The actor had returned to his room at the Pacific Rim alone early on Saturday morning having been out with friends earlier in the evening, said Mr Lepard.
Calgary-born Monteith had checked into the hotel on 6 July.
In response to a question about whether the actor died of a drug overdose, Mr LePard said he would “not discuss anything that we might have found in the room at this time”.
Coroner Lisa Lapointe said: “We do not have a great deal of information as to cause of death.”
An autopsy is scheduled for Monday.

Monteith described himself on Twitter as “tall, awkward, canadian, actor, drummer, person”.
He was treated for drug abuse aged 19 and had been open about his battle against addiction, telling one interviewer he took “anything and everything”.
When he entered rehab in April this year, girlfriend Lea Michele issued a statement saying she loved and supported Cory. “I am grateful and proud he made this decision,” she added.
Michele played Monteith’s opposite number Rachel Berry in Glee, which follows a group of American secondary school misfits who form the glee club in their quest for singing contest glory.
As Hudson, Monteith played the school’s star quarterback who risks alienation by his friends after joining the club.
Known for its melodic covers and celebrity cameo appearances, Glee’s four series had made global celebrities of its cast. The show featured guest spots by Britney Spears, Gwyneth Paltrow and Neil Patrick Harris.
Cory Monteith had not featured in the final episodes of the fourth series earlier this year and was understood to be seeking treatment for his addiction issues.

He had been expected to take part in the filming of the fifth series, due to air in the US in September.
TV network Fox offered its thoughts and prayers to Monteith’s family.
“Cory was an exceptional talent and an even more exceptional person,” said a statement by Fox. “He was a true joy to work with and we will all miss him tremendously.”
Glee co-stars expressed their shock at his death and offered condolences to his loved ones.
Singer and former Glee star Kristin Chenoweth wrote: RIP Cory Montieth. You will be loved. Always.”
Dot-Marie Jones, who plays the butch-but-sensitive American football coach at Glee’s William McKinley High, tweeted: “I have no words! My heart is broken. Cory was not only a hell of a friend, he was one amazing man that I will hold close to my heart forever.”

Speaking before training commenced on Tuesday morning at the FIFA Goal Project site in Abuja, Keshi who started his foreign career in Cote D’ Ivoire, said the people are passionate about football and they will do anything to defeat Nigeria, hence the need to forget the 4-1 win in Kaduna and concentrate on the return leg.

US, EU condemn Nigeria's inability to hand over President Al-Bashir

ABUJA—The United States government and European Union, yesterday, condemned the Federal Government’s refusal to hand over the Sudanese President, Omar Al Bashir, to the International Criminal Court, ICC, for prosecution over alleged crimes against humanity.
The Sudanese leader was in Abuja last weekend, to attend the just concluded African Union conference on HIV/AIDS, tuberculosis and malaria.
In a statement by Information Officer, Rhonda Ferguson-Augustus, the U.S. government said:  “We regret Nigeria’s decision to welcome a visit by Sudanese President, Omar al-Bashir.
“ President Hassan al-Bashir and other Sudanese individuals are subject to ICC arrest warrants for genocide, war crimes and crimes against humanity committed in Darfur.  It is serious cause for concern that these individuals remain at large and continue to travel across international borders.”

Reacting to the EU said Nigeria ought to have refused the Sudanese President entry into the country in accordance with ICC’s arrest warrant place on him.
The EU, in a statement by High  Representative, Catherine Ashton, said:  “The High Representative is concerned by the visit of President of Sudan, Al-Bashir, to Nigeria , a state party to the Rome Statute of the ICC.”
The EU noted that President Al-Bashir was under an arrest warrant by the ICC for war crimes and crimes against humanity.
It reiterated the importance for all member states of the United Nations to abide by and implement the resolutions adopted by the Security Council under Chapter VII of the UN Charter, in this case UNSCR 1593(2005).

Last Friday, the Court of Appeal, Lagos quashed the death sentence which Justice Mojisola Dada of the Lagos High Court handed Major Hamza Al-Mustapha and Alhaji Lateef Shofolahan over the death of Alhaja Kudirat Abiola. The appellate court said that the court below convicted the duo at all cost despite the prosecution’s failure to prove its case beyond reasonable doubt.

THE Appellant, in a 326 pages Judgment of the High Court of Justice, Lagos State in Charge No 10/37C/03 Coram Moji Dada J. was convicted for the offences of conspiracy to murder and murder of Alhaja Kudirat Abiola. The Charge initially included Chief Superident of Police Mohammed Rabo Lawal, but he was discharged on a no-case submission made on behalf of the Defendants.
FACTS OF THE CASE
The case of the Prosecution is that the Appellant conspired with another to murder and allegedly did murder Alhaja Kudirat Abiola on June 4, 1996, along Lagos-Ibadan expressway opposite Cargo Vision, Ikeja Area of Lagos State.
The Prosecution called four  witnesses, namely: Dr. Ore Falomo (PW1), Barnabas Jabila, a.k.a. Sgt. Rogers (PW2), Mohammed Abdul a.k.a. Katako (PW3) and D.C. Yusuf (PW4), while the Appellant called two witnesses and testified himself.
The facts leading to this appeal can aptly be put as follows. This trial started at the Lagos State High Court as ID/43C/99 in which the present Appellant with Mohammed Abacha, Rabo Lawal and one Mohammed Abdul were charged with conspiracy and murder. Mohammed Abacha was eventually discharged by the Supreme Court on July 11, 2002, on the ground of non culpability. The charge metamorphosed into the present Charge No ID/37C/2003.
No eyewitness on record
Noteworthy is that the crime, subject matter of this appeal was innitially investigated by the Nigerian Police Force at Panti in 1996, a Special Investigative Panel, SIP, and the Agbaje Panel set up in 1998 by the Government of General Abubakar Abdusalami. The accused persons were absolved of any involvement by the SIP and the Agbaje Panel in the death of the deceased.
On June 4, 1996,  the deceased was shot dead. There was no eyewitness on record to the actual crime, but one Dr. Mark Adesina whose statement is recorded at pages 10-18 of Vol. 1 of the Record of Appeal and whose name is listed as number one in the list of witnesses at the back of the information but was never called as a witness.PW1-Dr Ore Falomo witnessed the removal of a white bullet which was taken by the police. He testified that the deceased died after a head surgery and after her second cardiac arrest. Autopsy was conductyed on the deceased. After the commission of the crime, some members of the Abiola household were suspected of the commission of the crime. At the trial, the prosecution called four (4) witnesses, PW1, PW2, PW3, and PW4 respectively, while the Appellant called two (2) witnesses.

PWl – Dr. Oreoluwa Falomo testified that he was going to Ikosi on the 4th of June 1996 when he saw people running in front and thought it was an accident. He, as an orthopaedic surgeon thought he could help. he then saw Alhaja Kudirat Abiola slumped on the back of the car and the driver also shot. He recognised them as he had known these victims before. He arranged for a vehicle to rush them to the hospital. The deceased had been shot on the forehead and was bleeding from that spot. The driver had also been shot, but his condition was not as bad as that of the deceased.
One Dr. Ogunbanjo, informed him that the victims were in Eko Hospital. He went there and saw the deceased and a consultant who advices an urgent surgery. Two neurosurgeons agreed to work together. Alhaja Kudirat Abiola was still unconscious and bleeding.
, She was operated on and a special bullet that was not commonly seen was extracted from her skull. The operation lasted about two to three hours. She suffered a cardiac arrest. She appeared stabilized, but she suffered another cardiac arrest and she passed on.
A post mortem examination was performed on her body by one Dr. Alimi, who issued a report. He took part in moving the body to her house for burial. He made statement to the Police.
He told Police that it was a 5th Columnist in the Government that killed the deceased, going by the look of the bullet. The Police took the bullet away and never released it to them after the post mortem examination. He had told the Police that the bullet belonged to the family of the deceased in mediolegal term.
He had known the Abiola family and indeed was the personal physician and friend to the late Chief M.K.O. Abiola. He was very very close to the family.
Under cross-examination he said he had not trained as a ballistician, but he described what he observed as a doctor. He did say that the Police took away the spent bullet by force and said they needed it for investigation. The Police were picking and choosing what they wanted him to write in his statement. He had made many statements, about four, but he is surprised that he is shown only one.
He testified that he had met the Appellant before, and indeed he facilitated his visit to Late Chief M.K.O. Abiola when he was in detention at Aso Rock Villa. He was not shown Exhibit “A1″ before he came to court. It was his first time of seeing the document since he made it.
PW2 is Barbarnas Jabila alias Sgt.Rogers.He is a soldier of the rank of a Sergeant. He worked with the strike force in the Presidential villa in Abuja, before joining the Nigeria Army on the ih of January 1987, and trained as a parachooter Antitank Commander, Strike Security Force, an antiterrist outfit and attended a special course in North Korea. He knows the Appellant as the Chief Security Officer to Late General Sanni Abacha. Rabo Lawal was the officer in charge of Mobile Police in the Presidental villa. The Appellant used to send him and Rabo Lawal on assignment, and Rabo Lawal used to lead them when on assignment. His duty is to provide security as assigned by the Appellant as Special Anti- terrorist outfit and other special assignments. One Lateef Shofolahan used to give them information.
He knows the deceased, and the Appellant gave them order to elimnate her because she was doing some bad things against the state. When she came back from Burkina Faso, the Appellant gave them the order to move in and provided logisitics that they should stay at Dodan Barrack.
O/C Mopol took them to Alhaji Lati who in turn took them to  Abiola’s home. That Alhaji Lati gave them information that the deceased would soon move out. As soon as the deceased came out, he opened fire. That one Rabo Lawal gave money to Lateef Shofolahand to give them. The date in which he opened fire on the deceased was the 4th of June 1996. He returned the arm to the Appellant through his orderly Karo who confirmed receipt. The gun looked like MP5.
He was shocked that the secret leaked. It was not supposed to leak, as he was doing his job. The Appellant told him to keep quiet and that he should deny everything. At that time, Abacha had died.
On the day of the incident, they drove a 504 station wagon given to them by Dodan Barracks. The deceased was in a while Mercedes Benz. As she drove out of her premise, they trailed the Mercedes Benz to one round about, where the people in the Mercedes Benz dropped one small girl. The vehicle moved towards Alausa Secretariat and they trailed it until they got to an express road. They went closer and he opened fire at the car directly. After that he told Katako to drive him back to Dodan Baracks,
Foreign posting
Under cross-examination, he did testify that all he had said in examination-in-chief concerning the alleged involvement of the Appellant were things he was told to say by the Federal Government and the Lagos State Government. And that there are certain things which the Lagos State Government does not know.
The Attorney General of Lagos State, Yemi Osibanjo and the Solicitor General of Lagos State, and many others of Lagos State visited him when the case was being investigated by the SIP. The SS facilitated the visits of SSS because he was in their cell. He was given a promise by the authorities for agreeing to be a witness in this case. He was promised a house, job for himself and his Wife, security for his family and a foreign posting. His wife was moved to Abuja from Jaji where she was given an initial monthly allowance of N15,OOO, but later increased to N20,OOO. The money got to her through SSS.

Anytime the authorities visited him in the SSS cell where he was detained, they gave him money. Chief Bola Ige gave him N100,OOO.00. his handset and link was given to him by the Attorney General of Lagos State. He agreed to testify against the Appellant as part of his duties to the State. In 2005, inspite of the promises which the State made, he was being paid half salary. The promises made to him were not fulfilled.
His statement of September 29th 1999 was made during the S.I.P, and that was the time that they discussed what they  would give him. The statement was a response to the promise. During the S.I.P, and SSS officer  prostrated to him and said he would be told to go and on the way he would be killed.
He was afraid and cooperated.
Under cross-examination, he said on the 4th of June 1996, he was in Lagos. He heard about the deceased assassination in the news. He heard it on .the radio in Abuja. He also heard the news on that day he was in Lagos.
In his statement of 27th May, 1999, Exhibit DI-1 he said he was in Abuja.
He said he told one Okoloba that it is not the schedule of duty of the Appellant to issue out arms and ammunition as they have armourer. The Armourere registers your name and give you the arm and ammunition. He testified that as a government official his role was to carry out what he was told, not to make findings. He cannot remeber what he said but he did what they wanted him to do.
Cross examination
Exhibit A2 – his statement of 29th of September 1999 was produced by him and the Government official. That if Katako said it was a Cherokee jeep they rode on that date, he would be surprised. Under cross examination, PW2 testified that he justified his involvement in the murder of the deceased. He said what he was told by the authority. The authorities promised not to bring them to court, but they reneged.
PW3-Mohammed Abdul alias Katako, a soldier who joined the Nigerian Army in 1998. In 1996, he was told by Late Ibrahim Abacha that there are some people  coming from Abuja to Lagos, whom he should drive. Hear him:
“Between January and June 1996, when they came, so we went to National Theatre, that was where I saw Alhajj Lati, the 3,d Defendant, we went to Ikeja with him and went back to his house in Surulere, and we left him there and left the next day. Rogers said we should go to Ikeja to the same house we went with Lati. Mercedes car came out of the house, Rogers said we should follow the car. He stopped somewhere and dropped somebody and continued to lagos-Ibadan Expressway around seven-up. Rogers said I should drive close to the car and he fired and then said I should drive back to Dodan Barracks”.
That the house they went to, he was later informed was late Chief M.K.O. Abiola’s house. There were about 3 or 4 people in the Mercedes Benz car. They dropped a woman on the way. That when they got back to Dodan Barracks, Roger told people “we got am” but he did not know who was being refferd to. Later on he heard that it was the deceased. The people with whom we went were Skongama Bello and Late Samaila Shaibu.
Under Cross examinations, he said the shooting took place after the toll gate on the way going to Lagos. He made a statement in Abuja. He is aware that his statement was later translated into English Language, but he does not know who did the transaltion. However, he signed it after the English transaltion was read to him and he said yes. He does not know if he wrote Cherokee jeep, bur he did not ride a Cherokee jeep.It was a daybefore the day of the incident that they used a grand Cherokee jeep. He was offered promises including the gift of a house-in 1999   around September or October. These promises were made by officials he was with.
Officials of Lagos State Ministry of Justice visited him many times in Abuja while he was detained, including the Attorney General and Solicitor General of Lagos State. The Federal Attorney General Bola Ige visited him. He was given a house in Jos. They said that they would take care of him and his family. Promises were made to him before he wrote his statement. The promises were made to him on the 18th of September (the witness cried at this stage). His statement of the 19th of September was as a result of the promises of the 18th of September.
He said that on the 4th of June 1996, he had his first marriage at Azare in Bauchi State.
Under cross-examination, he said that he was in his village at Azare on the fateful day.
PW4 – Ahmed Fari Yusuf, was a police officer, now retired after 35 years of service. He retired as Commissioner of Police in charge of Budget Section, Nigeria Police on October 1, 2009.
He last served at the Police Force Headquarters, Louis Edet House, Area II, Garki, Abuja.
In 1999, he was in Abuja Force Headquarters. Between September December 1999, he was in Force C1D Area 10, Abuja. ‘-’Between September-December 1999, he was in Force CID Area 10, Abuja as Assistant C.O.P.
He knew the Appellant in September 1999, as he was brought to the Force C1D in connection with an alleged offence by the then SIP, which offence was for the alleged murder of Alhaja Kudirat, the burning of Guardian House and’attempted murder of Alex Ibru.
When he was brought, he was cautioned and he made a statement in his own handwriting. He witnessed the first statement made by him. Exhibit A-3 – statement made on the 23rd of September 1999.
After Exhibit A-3, he is aware that the Appellant was further interrogated by SIP detailed to carry out investigation and that he made a further statement.
That one Lateef Shofolahan also made a statement on the 21st of September 1999 in his own handwriting.
After, there was a trial within trial for twelve months, he disappeared into thin air and was never cross-examined (from records).
He tendered statements of the accused persons which were all admitted after trial within trial and objections for their admissibility failed.
On the 23rd of November 2010, PW4 was absent from Court, when trial was to have continued and the case was adjourned to the 20th of December 2010 (page 1060 of the Record of Appeal). After series of adjournments, the Court foreclosed the prosecution on the 14th of March 2011.

On the 4th of July 2011, the Appellant Major Hamza AI Mustapha testified on his behalf as DWl. He testified that he was arrested in October 1998, under an allegation that he was keeping the property of General Abacha. When they could not establish anything against him, they changed the allegation to gun running from Libya, then to overthrowing of the government of Abdulsalam Abubakar. it was changed to securing the property of the culprit of 1997 and later when all there were cleared, he was alleged to plan coup plotting to remove Abdulsalam Abubakar from government. He was cleared and when the government handed over to General Obasanjo, this created yet another allegation under a script called YAKASI says Prison Note.
He was investigated by the Police, and later to the Homicide case that brought him to Court on the 14th of October 1999. That Yakasi prison note was a script written by the Government of General Abdulsalam Abubakar in order to continue to keep him in detention having been cleared by numerous panels he established in 1998 and 1999. He was further subjected to interrogations and investigations by reason of that prison note of Lieutenant Colonel Yakasi, because of the events that happened from the murder of General Abacha to the murder of Late M.K.O. Abiola, and the subsequent event that happened right in his presence in the presidency. For fear of him divulging these, he has been persecuted and theY,pave keep him in detention.
He was Chief Security Officer to the former head of state General Sanni Abacha since the lih of November 1993. His career is that of Intelligence for Nigeria. What has to do with intelligence management for the Army and for the country is where he belongs. His primary and secondary assignments begin and end with:
(1) Security to the late head of State and Commander-in-Chief
(2) Security to members of the first family and
(3) Their property and seat of government
The various panels he faced from 21st October 1998 include :
(1)CHQ Panel on the investigation of the personal belongings of culprit of 1997, initiated by the office of CJS in the presidency- He was cleared and returned to Enugu-He was in fact commended.
2. Panel chaired by Major General Yusuf from Arm of Coat, who investigated the allegation fro gun running and he was cleared.
(3)          Allegation for Abacha’s personal properties of which he was cleared.
This means that no one else irrespective of rank, position or situation, should use another soldier’s rifle. That is Military Law. The Armourer is the officer in the arm who has the custody and control of weapons.
Military officers or non commission officers are only authorized to move from one location to the other or between one town to the other as military pass. By this, every movement must be on the basis of the data provided in that form. Any movement without that pass or the content and the authority and stamp in that pass is considered iliegal and is punishable by military law.

On the PASS, it contains the name of the officer, or the non- commission officer who is authorized to go on pass, his initials, rank, his service number, purpose for which the pass is issued, jurisdiction for the pass, location that the pass is intended, the nearest military formation to that location that the person is authorized to go to and the nearest police military formation, it also bears the signature and name of the authorizing officer, that is the commanding officer and the stamp of the unit.
It bears a note underneath that says if in the likely event of any is the C.S.O. who has a secretariat headed by a S.S.S officer called the 5LO (i.e Security Liaising Officer). 3year-old boy abducted in delta

WARRI — SUSPECTED  kidnappers, Monday, abducted a three-year-old baby, Destiny Osanebi, from the residence of the parents, Mr and Mrs. Lucky Osanebi,  in Ashaka, Ndokwa East Local Government Area, Delta State.
Member, representing Ndokwa East in Delta State  House of Assembly, Mr Friday Osanebi, confirmed the kidnap of the child when contacted, yesterday, saying: “The father of the child is my elder brother.”
Vanguard was reliably informed that the gunmen contacted the family,  yesterday asking for N10 million ransom.
“Three gun-totting kidnap gang laid siege to the home of Mr Osanebi on Monday and held his family hostage at about 10.00 pm. They robbed family members of cash, phones and other valuable property, before abducting their son.”
“The gang established contact with the family on Tuesday morning demanding N10 million, this is ridiculous, the child is only three years, four months old,” our source added.
Mother of the child, who said she was still dazed by the incident told Vanguard on phone it was true her child was kidnapped.

Two veterans from the old and new generation have taken center stage to remix a classic song from the early 1960’s. Coming together was the iconic Dr. Victor Abimbola Olaiya and the energetic 2face Idibia who performed a song from Dr. Olaiya’s early collection “Mofe Muyan,” now christened “Baby Mi Da.”
Spellz produced the remixed song, and Nollywood’s finest, Director Kunle Afolayan of “The Figurine” fame, made this his music video debut.
Premier Records ltd, the label under which Dr. Olaiya is signed, sees the collaboration as a way of uniting musicians from different generations; it is also provides a cultural background and timelessness.
“It is pertinent that we bring back to the music industry what made Dr. Victor Olaiya internationally known,” said Michael Odiong, Project Manager of the Premier Records. “His lyrics are still very relevant today, and he has so many tracks like ‘Ilu Le O’ and ‘Mr Judge’ that have an impact on people everywhere, and his classic love songs like ‘Omo pupa’ ‘Fami Mora O’ will withstand the test of time any day. We want to encourage younger stars to take advantage of these classic songs and do something new with them.”
At the video shoot, veteran producer/director, Mr. Tunde Kelani, and Navio from Namibia were on hand at the Stadium Hotel to support the team.

OJB slams juliet ibrahim for $100,00 kidney transplant comment

Ghanaian actress Juliet Ibrahim posted a message on her instagram page last week saying kidney transplant does not cost more than $50k and wondered why people raising funds for OJB were requesting for $100, 000.
OJB has responded to her. The ailing music producer and singer told Encomium magazine:
“The mistake she’s making is that it depends on the hospital you are going to in India. She says she runs a foundation, they might give her a rebate. The procedure itself is $55, 000. When you take out $55, 000, you are left with $45, 000. What about the running cost of the procedure? You don’t go to India only to come back and start asking for help again. At least, I need some money to maintain myself for the next one year. So when you factor in all these costs, add air tickets and lodging, you will appreciate what we are talking about

North West isn’t ready for her close-up just yet. The first daughter of Kim Kardashian and Kanye West won’t be making her big debut in the spotlight anytime soon — for any price. The media-savvy couple have yet to share any photos of their tiny bundle of joy since welcoming her into the world on June 15, though they’ve been offered a whopping $3 million from an Australian magazine to do so.
“Kanye’s been adamant about not having the baby on the show,” an insider tells Us Weekly. “He was serious when he said North isn’t America’s baby, so he may not do anything.”
The rapper’s protective, paternal instincts move beyond just maintaining North’s image, however. West, 36, has been a doting father to his daughter, becoming a “super worrywart” over her and trying to stay by her side as much as possible.
“Kim told him it was good to get out!” a friend of the Yeezus rapper tells Us. “He couldn’t wait to get back. North is all they talk about.”
His new family-centric attitude is even starting to affect Kardashian, 32, who has toned down her usual social media frenzy in the past few weeks, only breaking her silence to wish sister Khloe a happy 29th birthday on Thursday, June 27.
